Former President Trump Asks Top Court Clearance for Military Reserve Personnel in Chicago Area
On the last weekday, the White House petitioned urgently to the federal top court, seeking authorization to send national guard troops to Chicago and surrounding areas.
This move is part of a larger campaign to expand the domestic use of the military in a number of cities run by Democrats.
Legal Battle Over Military Presence
In an emergency filing, the justice department urged the court to set aside a earlier court order that had blocked the stationing of a few hundred state guard members to the Chicago area.
The district judge had voiced concerns about the government's reasoning for sending troops, challenging its rationale in considering local conditions.
A federal appeals court supported the lower court’s decision on midweek, leaving the activation on hold while the judicial dispute continues.
White House's Claims
The top government lawyer, speaking on behalf of the White House, stated in the latest petition that federal agents have repeatedly been “threatened and targeted” in downtown Chicago and the suburb of Broadview.
This area is home to an ICE holding center.
The president has earlier sent national guard forces to Chicago and Portland, following prior deployments to Los Angeles, California, Memphis, and Washington DC.
The White House has claimed that military intervention is required to reduce protests and strengthen deportation efforts.
Partisan Resistance
Opposition leaders have strongly opposed the decision, saying that the president’s claims are overstated and driven by politics.
They charge the president of misusing his executive power to punish opponents.
Judges have also voiced skepticism about the administration’s depiction of ongoing incidents.
City officials say that protests over ICE activities have been mostly limited and peaceful, challenging the administration's description of “battlefield” conditions.
Statutory Grounds
At the core of the conflict is the president’s use of a national law permitting the commander-in-chief to federalize the state guard only in instances of uprising or when “incapable with the federal troops to execute the regulations of the US”.
The government maintains that the forces are required to protect federal property and agents from protesters.

Earlier this month, the White House took control of several hundred troops of the Illinois military reserve and directed additional guard from Texas troops into the Illinois.
As city officials condemned the action, the president escalated his rhetoric, calling on the apprehension of Chicago’s mayor and the state's chief executive, each a Democrat, alleging them of failing to secure immigration officers.
The state of Illinois and the city of Chicago filed a combined lawsuit the administration to block the activation.
On the ninth of October, the presiding federal judge, nominated by President Biden, delivered a preliminary order preventing the command.
